    Default Illinois Lien Sale Procedure

    Does anyone have a procedure on how to conduct a lien sale in the state of Illinois? I have a copy of the Illinois lien law but the devil is in the details. Knowing when a lock can be cut or if a auction can still be held after the specified property sale date would be most helpful.

    Hey, storeguy. As best I can remember, it is like this.

    1. Overlock and access denial at 6 days.
    2. Lock cuts after 30 days.
    3. Auction after 30 more days after certifieds.
    4. Newspaper ads atleast 7 and 14 days prior to auction.

    This is the same as Florida, and many other states. This information should be checked through your Association.

    Some folks send out a separate "lock cut" notice but I'm wondering if I could incorporate it in my certified letter lien notice. We send out enough mail already and many times to addresses that are no longer current.

    Here is a Tip:

    Send your certified letter and also send a copy via regular mail. Put on your Return Address Label - Return Service Requested. This is a free service from the USPS. They return the letter with a yellow label with the forwarding address. I have been doing this for years. I learned this trick from a landlord friend of mine.

    Illinois Lien Laws I am not familiar with. You may try to network with other facilities to see how they do it. Most managers are very helpful to each other, at least they are here. Good Luck.
