No...Feb. 14th came and Feb. 14th went. BUT, I got an e-mail from his wife today letting me know that the good doctor is once again stuck in Nigeria and wants to know that their equipment is safe. I am kinda torn as to what to do. Part of me wants to charge them (that's the evil business woman) and the other part of me just wants the stuff to go to Nigeria.

But, I really prefer e-mails from the lovely wife. It saves me from having to have her scream at me!!

Any opinions on what I should do now? Uncle Lou?????????????

I think it might be time for you to start the auction process. Maybe he doesn't take you seriously. Maybe seeing the paperwork will put a fire under his butt! It's now or never buddy. If I were in your shoes I would feel guilty too BUT he has had plenty of time to figure out what he needs to do with it. Your owners are questioning you about it as well right? I say stop feeling bad for him! He and his wife have one excuse after another. Start the auction process and see what he does.

Since this has been a completely donated unit, do I need to pre-lien, lien, etc. just like I do for other auction units? I have a contract with him, but there has never been any money exchanged. I feel completely ABUSED!

Even though it is donated you did do a contract..did you put in the contract it would be for a certain time? I live in Texas so not sure how your auction process goes but I would do it like any other unit. Open the unit and take a picture..send him the paperwork..certified and regular mail. Maybe if he sees that your not messing around any more he will get the picture! If you ever do this again make sure you put in the special provision section of your lease how long you are donationg the unit for. Start with the paperwork and see if it gets his attention. If he really cares about getting the medical stuff there he will get his act together (I hope). No more excuses, you did your good deed..now it's his turn!

Try this. Most lease, if not all, have a clause stating that you may change the lease with 30 days written notice.

Send the tenant a rate increase letter to take affect in 30 days. Go all the way to street rate or more. As soon as legally allowed by your lease, start auction processing for non-payment, and carry on as in addition. The very worst that can happen is that he will start to pay rent.

Great idea, Bob! Sometimes the obvious solution doesn't sound obvious when you're overwhelmed with all the drama!!! I have found myself stuck also because of the bad weather we've been having the past several weekends giving people "a few extra days" to move out and they're taking advantage of it & it is now stretching to a month!!!!

I am curious, is that or was that the only 10 x 15 available? I would also imagine it may not be the easiest nor cheapest thing to do is to ship this half way around the world.
We also have a few donated units but we have a clause in our lease the we can give a 10 day written eviction notice.

It has put you in a difficult position, but he may still have good intentions but just don't know how to proceed with getting the items over there, just a thought...

Thanks Bob...of course, I never thought of that! But, will do it right now. I appreciate all the ideas from you guys, cuz this one had be baffled. I'm sure the guy is legit, but when something is free--it may not be a priority to move it. This guy is out nothing--a medical company (friend of my owner) donated all of the medical supplies. Oh well, we'll seee how he handles the rate increase! THANKS!
