Is West Virginia where you're located Handyman? We would have no way of knowing that since you don't list your location in your profile.
My location has been listed since the day I registered. I think everybody here is astute enough to know that lien laws are different from state to state. For example, here in CA: " 21707. (a) After the expiration of the time given in the notice of lien sale, pursuant to subdivision (a) of Section 21705, an advertisement of the sale shall be published once a week for two weeks consecutively in a newspaper of general circulation published in the judicial district where the sale is to be held. The advertisement shall include a general description of the goods, the name of the person on whose account they are being stored, the space number of the occupant, and the name and location of the storage facility. " It's obvious that in West Virginia, a general description will not do, but here in CA it is just fine. Your point about checking in your particular state is well taken, I may be at fault for assuming that most already are aware that there are differences. |

This is one of the few times it pays to live in California!
I am with the rest here - I take pictures from the door! The only time I enter a tenants unit is if it does not sell at the the auction - then it is just to clear out the crap and fill the dumpster! If I see something in the unit that I may want to bid on I will have a friend or relative come in and bid on it for me. This helps to keep the separation in place.

Same here -- winning bidders get everything (and must take it ALL with them).
I require a cleaning deposit for all winning bidders - it can range between $40 and $100 -- this encourages them to clean it out completely! Only once have I kept the cleaning deposit. going back to the original area of this thread -- if they find something illegal they can bring it to me and I will arrange for it's disposal. So far I have disposed of 4 bongs, 7 throwing stars and 1/4oz of green leafy substance. I have contacted the authorities about the disposal of these items and they tell me to just destroy them and toss them into the dumpster or flush it down the drain as these items would be just a misdemeanor and can't prove ownership. I have been advised that if I find larger quantities or items of a felony nature that I am to call them and seal off the unit.

We recently found about 100 rounds of various ammunition in a unit. We called the police to ask them to take it away, which they did without a problem. They said they would dispose of it for us. I have firearms but I did not want to dispose of it myself or have any bidder handle it. The PD was happy to take it.
We require winning bidders to return any personal and private items (papers, etc) to us and we will contact the renter. We had one girl who was a stripper leave a few choice photos and "clothes" which we trashed it after it sat in storage for 2 years. Another person returned photo albums and some personal papers which we gave back to the renter. I have yet to have any "green leafy material" returned by buyers! ![]() |
