The additional unit is not his. Technically, you can empty it and toss the stuff because there is no lease for that space. I would let him know he has 24 hours to clear it out or it will be tossed. Period.

I agree with this, if there is no signed agreement for the unit, it is not his. Put his stuff in front of his other unit, let him know it is there if he wants it and terminate the other lease.

We keep our vacated units locked. Upside no one can move in unnoticed, downside we have to physically take them off or meet the tenant. Upside to meeting the tenant, you know who is moving in

An unlocked unit leaves that whole building venerable to break-in. It's like locking all the doors to your house but one. Thieves can then go through the dry wall ceiling and get into other units. Think of that mess and the repairs!

I think I'll terminate his lease and give him 7 days to move out. I know if I allow him to stay he'll cause more trouble. The DaVinco locks look like a good solution to avoid extra trips to the facility. It looks like they're out of the red ones though. Do you have an issue with tenants not returning the locks?

Usually with the Davinci you would place a fee on the lock for not returning it. Davinci suggest (at least about a year ago, it may have changed) a fee of $50.00 for not returning the lock, we were thinking more like $25.00 for not returning them, also you would provide a dropbox for them to be returned to (you may use your already existing payment dropbox if you have one as well). and I would suggest putting up signage either on the dropbox or some where in the office stating there is a fee for not returning the overlocks.

You may also buy Davinci locks from www.supplyside.com along with the dropbox for them (but are also out of the red ones).

I'm fairly certain in my state (which is not yours), you can dispose of the items in the second unit, because that's deemed theft. There's no lease and you don't have an agreement.

This is why we use Davinci locks. We also don't accept cash- it brings in a different kind of tenant.

My facility is completely full so I'm very tempted to just throw his stuff away, but I'm hesitant because of the small chance of some type of legal action. I'm not a member of any self storage association. Is it worth the membership fees?

that's a terrible idea. Call an attorney! You can't just toss things! Normally now you have to go go court and do a formal eviction.

I've recently stopped taking cash as well. I generally have the worst problems with cash tenants. I didn't end up throwing out his stuff. After my final warning to lock him out permanently he finally moved out.

We accept cash and that won't change. However, since we prorate in (FOM billing) if someone comes the last week of the month and rents with cash, I have them pay the next month full rent as well. It has eliminated a lot of people trying to pay $30.00 and dumping their stuff to never return. Cards aren't always reliable either, not in some instances I've seen. I've had people pay with a card, put it on autopay, to never hear from them again and payment getting declined when rent is due again.

I definitely have issues with people who use cards too, but it seems like a higher percentage of cash customers are a problem. If they don't have a credit or debit card, that usually indicates a poor financial situation for them.

I also just ordered some red Davinci locks. The concept sounds good, but now that I've received them I can't use them because I'm not able to create an account online to retrieve the combinations. When I install the app on my phone, I follow the link to create an account but it doesn't work. I called today to get help with the account but the person on the phone couldn't help me and said a specialist would call me back, but never did. It's been a confusing and frustrating process so far. Hopefully when they get me an account set up it will work well.

With DaVinci locks, you can't create your own account online when you receive them, so you have to wait on someone from the company to create an account for you before you can use them. When you call the company the person who answers can't help with that you so have to wait on someone else to call you back which in my case was a couple of days.

When I received mine in the mail, I went to the website and created my account!
Please be aware that I was not the person who ordered them!

I went online and created my account when all I had was a sample lock from a trade show! Then I ordered from there right in my account.
