First off, I am fully aware that there should have been a signed lease.
So here is the situation. My uncle owns the facility and befriended this lady who has assisted him with doing some work around the facility, his house, running errands, etc... For the last 8 years (maybe longer), he has allowed her to use a 10x10 unit at no charge and no lease has been signed. Without going into detail and getting into the dynamics of the situation, I'll just say that there is now a rift between this lady and my uncle/myself. She told us that she was moving into a new apartment and would be taking her stuff out of the unit, but when pressed on it weeks later she hadn't moved out. Further, she has become recalcitrant. She has given no deadline as to when she would have her stuff out.
Since there is no lease, it is my understanding that the lien process doesn't apply. I could treat the items as abandoned and simply dispose of them. I would , however, like to give her written notice or a deadline but I do not have her new address.
Thoughts?
