Evict is usually used in a landlord/tenant situation. You want to use a straight and simple "termination of tenancy" per your contract. Let your attorney write up the notice that you're terminating his lease. No reasons, no explanations, just quote the section of your contract where it states...

Jerry3903, welcome to the forum. Is the tenant claiming via the Opposition to Lien that they have paid their rent and you haven't appropriately credited their account? They can't just oppose because they don't want the unit to go to auction. You need to sit tight on those units for the time being, sorry....

  • 24 hour access usually invites trouble. Unless it's a commercial tenant, there is nothing anyone is doing in a storage unit at 3:00 a.m. that's above board. It's time to terminate this tenant. Start by over locking the unit, have a chat with him and let him know, it's not acceptable to "hang"...

Always give the tenant a call, let them know their unit is unsecured and they are required to secure it to continue their lease. • In a local document they utilize the combo of "miniwarehousing/ministorage." I don't know that this helps at all. I've found no "definitions" but San Jose is massive and so are the rules and regs so I could've missed something. Even my last home City didn't have definitions in their...

Two months behind and more than ready to be auctioned. Providing of course, that you've mailed your notices out in a timely manner. Want me to come up and boot them out for you? I've got some time.
